Car "Three Guarantees" Regulations Entering the Legislative Process

China is set to announce and implement its "Three Guarantees" system for automotive products this year. The draft regulation, titled "Responsibility Regulations for Repair, Replacement, and Return of Household Automotive Products," has completed multiple rounds of discussions and pilot testing, and is now moving into the legislative process. This system outlines the procedures for repairing, replacing, or returning automotive products that have quality issues, following the principle that the seller is ultimately responsible for the three guarantees. According to the draft, the three guarantees will be valid for two years or 40,000 kilometers. During this period, if a vehicle has quality problems, consumers can request repairs, replacements, or returns under warranty. If any losses occur, sellers, manufacturers, and repairers are legally required to compensate accordingly. After two unsuccessful repair attempts, consumers can submit a return request to the dealer. Additionally, during the validity period, the repairer must provide at least one free maintenance service as per regulations. Under the Consumer Protection Law, goods listed under the "Three Guarantees" have clear legal responsibilities and straightforward return conditions. However, large items like cars have not been included in this system, which has led to difficulties for consumers in resolving complaints. As the number of vehicles on China’s roads continues to rise, issues such as complaint resolution, mediation challenges, and compensation have become major concerns for car buyers. It is also reported that another significant car consumption policy, which directly affects consumer interests, is expected to be introduced this year. This new regulation addresses sensitive issues like additional charges that car owners often face. For the first time, it clearly states that consumers have the right to refuse to pay unreasonable extra fees related to the purchase, use, and maintenance of their vehicles. In addition to this, the State Administration for Market Regulation (formerly AQSIQ), together with the National Development and Reform Commission and other departments, announced during the “3•15” period that a defective vehicle recall system would take effect from October 1st. Experts have noted that the defective product recall system and the "Three Guarantees" system address different types of issues. While the recall system targets systemic defects caused by design or manufacturing, the "Three Guarantees" focuses on individual, random failures. As explained by Wang Lijun, Director of the Product Division at the Quality Management Department of AQSIQ, the recall system is designed to handle widespread issues affecting entire batches of vehicles, even if they haven’t yet malfunctioned. In contrast, the "Three Guarantees" system deals with isolated incidents, where the responsible party is accountable for repairs, replacements, or returns. Together, these two systems create a comprehensive safety net for automotive product quality, effectively safeguarding consumer rights and interests.
